In a case of religious liberty whiplash, the same court that issued a stay on the HHS mandate for Liberty University turned around just hours later and reversed the stay, according to Liberty Counsel, which represents the University.
“Denying a stay while awaiting a petition for cert is not unusual, but it is unusual that conflicting orders are sent on the subject,”said Mat Staver, founder and chairman of Liberty Counsel. “The conflicting orders from the court of appeals do not have any relevant bearing on this case. We are preparing the petition to ask the Supreme Court to review the case.”
Enforcement of the mandate is scheduled to go into effect on January 1, 2014.
Liberty University’s challenge questions the constitutionality of not only the HHS contraceptive mandate but the constitutionality of the Affordable Care Act in its entirety.
