Ave Maria President Hopeful for Victory over Sebelius’ 'Zealots' in Religious Freedom Case

The president of Ave Maria University (AMU) called the Supreme Court’s decision to hear cases on the constitutionality of the HHS Mandate “great news.” 

AMU president Jim Towey said in a statement released to Catholic Education Daily,“Now our nation’s highest court will look at the First Amendment case law and the federal Religious Freedom Restoration Act and decide whether such efforts by Secretary Sebelius and her zealots at the U.S. Department of Health and Human Services were lawful or not.”

Towey cheered the U.S. Supreme Court’s decision to hear two cases concerning the infringement of religious liberty by the Obama administration’s Health and Human Services (HHS) mandate, which forces religious institutions to provide coverage for contraceptives, abortifacients, and sterilization procedures.

Towey expressed confidence in his statement that those opposing the HHS mandate would prevail.

Ave Maria has battled the mandate in court, a fact that Towey is proud of, saying, “our cause has been a just one.” The faithful Catholic university recently re-filed their lawsuit against the HHS Mandate. A U.S. District Court dismissed AMU’s initial filing as premature because the Obama administration had not finalized religious exemptions for the mandate in question.

“[F]aith-based organizations, whether non-profit or private, should not be compelled to violate conscience to carry out such a mandate,” said Towey. “The Obama administration could have expanded access to contraception through any number of methods –using its vast array of community health center and state public health clinics, but instead it chose the most offensive way possible:  it chose to force faith-based groups to be the foot soldiers in their armies of contraception.” 

AMU’s lawsuit continues in the U.S. District Court, Middle District of Florida.
